1. Introduction: Please read the following to learn more about the TOCA BOCA AB (“TOCA BOCA”) Privacy Policy. The TOCA BOCA website (www.tocaboca.com) and various related games, applications, features, content, widgets or services (collectively, the “Service”) are intended for use by the whole family including young children with parental participation and supervision. TOCA BOCA recognizes the importance of protecting any information collected from the users (each a “User” or collectively, “Users”) of its Service, and has adopted this Privacy Policy to inform its Users about the types of information TOCA BOCA gathers about a User online while using TOCA BOCA’s Service, how TOCA BOCA may use that information, whether TOCA BOCA discloses it to anyone, and the choices a User has regarding use of and correction of the information.

2. PRIVO®’s Privacy Assurance Program (“PPAP”): TOCA BOCA is a participant in PRIVO®’s Privacy Assurance Program (“PPAP”). As part of participating in the PPAP, TOCA BOCA adheres to the strict information collection, use and disclosure requirements. PRIVO is an independent, third party organization committed to safeguarding children’s personal information collected online, and to helping parents and their children exercise control over personal information while exploring the Internet. The certification seal posted on this page indicates that TOCA BOCA has established privacy practices and has agreed to submit to PRIVO’s oversight and consumer dispute resolution process. 3. Effective Date: The Privacy Policy detailed herein applies to any and all information that a User may have obtained from or provided to TOCA BOCA. TOCA BOCA reserves the right, at its full and complete discretion and without prior notice, to change, modify, amend, add, subtract, or otherwise remove portions of its Privacy Policy at any time and for any or no reason. Although TOCA BOCA may attempt to email Users a copy of the revised Privacy Policy at the email address on file, if any, please periodically continue to check the Privacy Policy at www.tocaboca.com/privacy for any changes. Such modifications will be effective immediately, and will apply to disputes arising under the Privacy Policy from the date of posting forward. A User’s use of the Service after the posting of any amendments, deletions or other changes to the Privacy Policy will constitute acceptance, acknowledgment and agreement to the respective changes.
4. Non-Personal Data: For purposes of this Privacy Policy, “non-personal data” means information that does not directly identify a User. Additionally, non-personal data means “aggregate” and “de-personalized” information, which is data TOCA BOCA collects about the use of the TOCA BOCA Service, from which any personally identifiable data has been removed.
TOCA BOCA will share some of the information it collects from the User upon install of the mobile app Service with vendors and other service providers who are engaged by or working with TOCA BOCA in connection with the operation of the services TOCA BOCA provides to the User and/or for analytics purposes which may require the reproduction and display of such information in an aggregated and anonymized manner such that will not in any way identify the User.
TOCA BOCA may use tools or third party analytical software to automatically collect and use certain non-personal data including, but not limited to: (i) device properties, including, but not limited to IP address, Media Access Control (“MAC”) address and unique device identifier or other persistent or non-persistent device identifier (“Device ID”); (ii) device software platform and firmware; (iii) mobile phone carrier; (iv) geo-location data; (v) game progress, time used playing, score and achievements; (vi) other non-personal data as reasonably required by TOCA BOCA to enhance the Service and other TOCA BOCA products and services. TOCA BOCA may use and disclose to TOCA BOCA’s partners and contractors the collected non-personal data for purposes of analyzing usage of the Services, advertisement serving, managing and providing the Service, and to further develop the Service and other TOCA BOCA services and products.
One such tool or service TOCA BOCA may use and disclose non-personal data to is the Mixpanel analytics tool for collect usage data for statistical measuring and other purposes, such as determining, among other things, how often Users access specific parts of the Service in order to allow TOCA BOCA to revise, improve and develop said services. Other tools or services that TOCA BOCA may use or disclose non-personal data to are third party advertisement serving technologies that use certain methods to collect information as a result of ad serving through the Service. TOCA BOCA or third parties operating the ad serving technology may use demographic and location information as well as information logged from the User’s hardware or device to ensure that appropriate advertising is presented within the Service. TOCA BOCA or third parties may collect and use data for this purpose including, but not limited to IP address, geo-location information, Device ID, MAC address, IDFA for iOS6 and higher, software, applications, hardware, browser information, Internet and on-line usage information, and in-game information.
This Privacy Policy does not apply to the practices of third parties that TOCA BOCA does not own or control, or to individuals that TOCA BOCA does not employ or manage. Although TOCA BOCA takes commercially reasonable steps to instruct third parties that provide ad serving technology to comply with the terms and conditions of this Privacy Policy, TOCA BOCA does not have access to or control of third party technologies. Third parties that provide ad serving technology may combine the information collected with other information they have independently collected from other services or products. These companies collect and use information under their own privacy policies. These ad serving technologies are integrated into Service; Users who do not want to be subject to this technology should not use or access the Service.
TOCA BOCA may display behaviorally targeted advertising to a User. Users wishing to “opt out” of certain targeted advertising should please visit http://www.mobileapptracking.com/privacy-policy and/or www.networkadvertising.org. Please note that the links above may not reach all of TOCA BOCA’s advertising partners and certain behaviorally targeted advertising may still be displayed the User. Users who want to be certain that behaviorally targeted advertisements are not displayed should not use or access the Service. Additionally, please note that if a User “opts out,” it does not mean that the User will no longer receive advertising. Rather, advertising the User continues to see will not be customized to the User and his or her interests and may be less relevant to the User.
To the extent that TOCA BOCA makes location enabled services available through the Service and the User uses such services, TOCA BOCA may collect and process the User’s location data to provide location related services and advertisements. For example, some add-ons or offers may be available only at dedicated locations. TOCA BOCA may use various technologies to determine general location, such as Wi-Fi or other network-based data, such as IP address. TOCA BOCA may share a User’s anonymous general location with its partners.
5. Personal Data: For purposes of this Privacy Policy, “personal data” means personally identifiable information that specifically identifies a User as an individual.
A User may make personal data available to TOCA BOCA by, for example: (i) completing any registration for the Service, for contests and for special events; (ii) accessing the Service using a third party ID, such as social networking sites or gaming services; (iii) subscribing to newsletters; (iv) subscribing to alerts; (v) purchasing a product or services through TOCA BOCA’s online stores; (vi) using “tell a friend,” “Share,” or other similar features, if available; (vii) requesting technical support; and (viii) otherwise through use of the TOCA BOCA Service where personal data is required for use and/or participation.
The types of personal data collected may vary depending on the type of activity the User is engaged in. The personal data TOCA BOCA may collect, process and use may include, but are not limited to the User’s name, screen/nick name, TOCA BOCA or third party service ID, e-mail address, photo or other image, birthdate, gender, friend connections, avatar image, credit card information, shipping information, and location (only if directly identifiable to the User, otherwise TOCA BOCA treats location as non-personal data).
TOCA BOCA may use personal and non-personal data, both individually and combined together, for purposes of analyzing usage of the Service, providing customer and technical support, managing and providing the Service (including managing advertisement serving), customizing TOCA BOCA’s communications and to further develop the Service and other TOCA BOCA services and products. TOCA BOCA may combine non-personal data with personal data.
TOCA BOCA may use a User’s personal data to send messages to the User with informative and/or commercial content about TOCA BOCA’s services or third party products and services TOCA BOCA thinks may be of interest to the User, such as new features and services, special offers and updated information.
Please note that certain features of the Service may be able to connect to the User’s social networking sites to obtain additional information about the User. In such cases, TOCA BOCA may be able to collect certain information from the User’s social networking profile when the social networking site permits it, and when the User consents to allow the social networking site to make that information available to TOCA BOCA. This information may include, but is not limited to, the User’s name, profile picture, gender, user ID, email address, country, language, time zone, the organizations and links on the User’s profile page, the names and profile pictures of the User’s social networking site “friends” and other information the User has included in his or her social networking site public profile. TOCA BOCA may associate and/or combine as well as use information collected by TOCA BOCA and/or obtained through such social networking sites in accordance with this Privacy Policy.
If a User contacts TOCA BOCA by email, TOCA BOCA will use the personally identifiable email address information only to respond to the specific inquiry.
The Service may use “cookies” and other technologies such as pixel tags, locally shared objects, clear GIFs and web beacons. TOCA BOCA treats information collected by cookies and similar technologies as non-personal data.
Cookies: A “cookie” is a small bit of record-keeping information that websites often store on a user’s computer. TOCA BOCA’s cookies do not include personal data and are typically used to quickly identify a User’s device and to “remember” the User. Users can disable cookies or set their browsers to alert them when cookies are being sent to their device; however, disabling cookies may affect their ability to use the Service.
Flash cookies & HTML5: TOCA BOCA may also use Flash cookies (locally shared objects) and HTML5 storage (locally stored objects). Locally shared objects are small files similar to browser cookies and are used to remember the User’s settings to personalize the look and feel of the Service. Locally shared objects only collect data in the aggregate. Users can prevent locally shared objects from being placed by disabling locally stored objects in their browsers or visiting www.adobe.com. Locally stored objects, such as HTML5 Web Storage, are used for similar purposes as cookies but typically may contain a greater amount and different types of data than browser cookies.
Web Beacons and pixel tags: A “web beacon” or a “pixel tag” is an electronic image that allows TOCA BOCA to count Users who have visited certain pages or viewed certain advertisements. Web beacons, like cookies, do not include personal data. E-mails and other electronic communications TOCA BOCA sends to a User may contain pixel tags that enable TOCA BOCA to track a User’s usage of the communication, including whether the communication was opened and/or what links were followed, if any.
6. Personal Information Shared: Personal data may be disclosed in accordance with applicable legislation and this Privacy Policy. Additionally, TOCA BOCA may disclose personal data to its parent company and its subsidiaries in accordance with this Privacy Policy.
From time to time, TOCA BOCA may hire agents and contractors to collect and process personal data on TOCA BOCA’s behalf and in such cases such agents and contractors will be instructed to comply with our Privacy Policy and to use personal data only for the purposes for which the third party has been engaged by TOCA BOCA. These agents and contractors may not use a User’s personal data for their own marketing purposes. TOCA BOCA may use third party service providers such as credit card processors, e-mail service providers, shipping agents, data analyzers and business intelligence providers. TOCA BOCA has the right to share Users’ personal data as necessary for the aforementioned third parties to provide their services for TOCA BOCA. TOCA BOCA is not liable for the acts and omissions of these third parties, except as required by law.
TOCA BOCA may disclose a User’s personal data to third parties as required by law enforcement or other government officials in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose a User or TOCA BOCA to legal liability. TOCA BOCA may also disclose a User’s personal data to third parties when TOCA BOCA has a reason to believe that a disclosure is necessary to address potential or actual injury or interference with TOCA BOCA’s rights, property, operations, Users or others who may be harmed or may suffer loss or damage, or TOCA BOCA believes that such disclosure is necessary to protect TOCA BOCA’s rights, combat fraud and/or comply with a judicial proceeding, court order, or legal process served on TOCA BOCA. To the extent permitted by applicable law, TOCA BOCA will make reasonable efforts to notify affected Users of such disclosure through TOCA BOCA’s website or in another reasonable manner.
TOCA BOCA may store and/or transfer User personal data to its affiliates and partners in and outside of EU/EEA member states and the United States in accordance with mandatory legislation and this Privacy Policy. TOCA BOCA may disclose User personal data to third parties in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of TOCA BOCA’s stock and/or assets or other corporate change, including, without limitation, during the course of any due diligence process provided, however, that this Privacy Policy shall continue to govern such personal data.
A User may choose to disclose data about him or herself in the course of contributing user generated content to the Service. Any data that a User discloses in in this way or in support forums, community blogs or the like is public information, and there is no expectation of privacy or confidentiality. TOCA BOCA is not responsible for any personal data a User makes public in any of these forums.
7. Third Party Terms and Conditions: A User’s access to and use of the Service may be subject to certain third party terms and conditions and privacy policies, including but not limited to application stores, mobile software platforms, on-line gaming platforms, social networking services and payment providers. TOCA BOCA is not liable for any such third party terms and conditions and their use of Users’ personal data.
TOCA BOCA may in its discretion make available links through advertisements or otherwise enable Users to access third party products or services. TOCA BOCA is not responsible for the actions of such third parties, the content of their products or services, the use of information a User provides to them, or any products or services they may offer. TOCA BOCA’s linking to those products or services does not constitute its sponsorship of, or affiliation with, such third parties.
Certain features of the Service that TOCA BOCA may offer, such as multiplayer gaming, social networking and gaming console services, may use third party services to provide authentication for the Services with a gaming console ID, social networking ID or gaming network account. A User who uses or connects to a TOCA BOCA Service or downloads a TOCA BOCA mobile app by or through a third party platform, such as Facebook or other social networking site, consents to TOCA BOCA’s access to and/or collection of certain information from the third party platform profile/account (such as his or her Facebook account) or via any cookies placed on the User’s device by such third party platform as permitted by the terms of the agreement and the User’s privacy settings with the third party platform. TOCA BOCA will share such information with the third party platform for its use as permitted by the terms of the agreement and the User’s privacy setting with the third party platform.
8. Data Retention and Accuracy: TOCA BOCA retains the data collected pursuant to this Privacy Policy for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. Thereafter if the collected data is no longer needed for purposes specified in this Privacy Policy, TOCA BOCA deletes all aforementioned data in its possession within a reasonable timeframe. TOCA BOCA does not verify the accuracy of personal data. TOCA BOCA may still retain some of the data to the extent such retention is necessary to resolve disputes, enforce TOCA BOCA user agreements, and comply with technical and legal requirements and constraints related to the security, integrity and operation of the Service.
9. Security: TOCA BOCA follows generally accepted industry standards and maintains reasonable safeguards to attempt to ensure the security, integrity and privacy of the information in TOCA BOCA’s possession. Only those persons with a need to process Users’ personal data in connection with the fulfillment of their tasks in accordance with the purposes of this Privacy Policy and for the purposes of performing technical maintenance, have access to Users’ personal data in TOCA BOCA’s possession. Personal data collected by TOCA BOCA is stored in secure operating environments that are not available to the public. To prevent unauthorized on-line access to personal data, TOCA BOCA data within a fire-wall protected environment. While TOCA BOCA exercises reasonable care and due diligence in providing a secure conduit of information between a User’s computer or other device and its servers, TOCA BOCA cannot and does not guarantee the security of materials or information transmitted to TOCA BOCA or other Users over the Internet or wirelessly. Therefore, while TOCA BOCA will attempt to protect the transmission of any information using methods which comply with the industry standards, TOCA BOCA does not accept liability for any unintentional disclosure of same.
10. Further Information: Users that wish to opt-out from receiving communications (such as any newsletters or offers) from TOCA BOCA, should contact privacy@TocaBoca.com.
TOCA BOCA makes good faith efforts to enable Users to review, update or correct any personal data in TOCA BOCA’s possession. Users should contact TOCA BOCA at privacy@TocaBoca.com. TOCA BOCA will need sufficient information from the User to establish the User’s identity and to verify the User’s access, and also to assist in handling the User’s request. Even if personal data is changed or deleted according to a User request, TOCA BOCA may still retain some of User personal data to resolve disputes, enforce TOCA BOCA user agreement(s), and comply with technical and legal requirements and constraints related to the integrity, security and operation of TOCA BOCA Services.

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain members of TOCA BOCA to third parties for the third parties’ direct marketing purposes.
